The new legislation is mainly amendments to current powers under the Criminal Justice and Public Order Act 1994, which the police have generally been reluctant to use in the past. The encampment will still need to be served with an eviction notice and a risk assessment carried out before the eviction can take place.
Therefore, the quickest route to an eviction will still be to use private bailiffs and certificated enforcement agents. This option can have the traveller encampment evicted in a matter of hours, rather than days.
