How to legally evict your tenant
In order to legally take back possession of your property, there is a specific process you need to follow. Our team of experienced agents will ensure you have everything in place and that all appropriate legislation and regulations are followed.
The first step for residential repossessions is to gain a Possession Order in the County Court. Under the Housing Act 1988 you will need to serve your tenants with either a Section 8 or Section 21 Notice first.
This will depend on the reason for wanting to take back possession of the property. A Section 21 notice of possession is used at the end of a fixed-term tenancy agreement and there doesn’t need to be any other reason. A Section 8 eviction notice is served when the tenancy agreement has been breached. For example, where there are rent arrears, damage to the property or anti-social behaviour.
Once a Possession Order has been granted these can be executed by a County Court Bailiff. However, they typically have long waiting times, depending on the area. Under Section 42 of the County Court Act 1984 you can request that the order is transferred to the High Court. This is then enforced by a High Court Enforcement Agent through a writ of possession. It is quicker and easier to ensure that this request is made at the initial possession hearing.

Residential Repossession Package
Where you have a Possession Order from the County Court that provides permission to transfer up to the High Court, we will start this process straight away. Once the Writ of Possession is received back, we will serve the tenant(s) and any other occupier(s) with a Notice of Eviction. This provides them with at least 14 days to leave the property and gives an exact date and time of the eviction.
On the date, our agents will attend at the property with yourself or your agent to take back possession of the property. We provide a comprehensive residential repossession of property service.
