Where travellers arrive on private land it can be extremely frustrating and stressful for the landowner. Whether the encampment is in a private car park, office site, leisure facility or other types of private land, there are quick and effective means of evicting them.
If you are a private landowner who is having problems with a gypsy encampment, the local council and police are unlikely to assist directly. How long does it take to evict travellers from private land?
There is no exact time as to how long it will take to conduct a successful eviction. At CEA Limited, our enforcement agents can be on site within a matter of hours to serve the group with an eviction notice. This typically provides them with 24 hours to leave the site, otherwise, they will be evicted forcibly.
There is also the option for our agents to remain on-site following the serving of the notice to conduct a same day eviction. In this case, dependent on the time of day, weather conditions and police assistance, our agents would give the group approximately two hours to leave the site. If they fail to leave willingly, an eviction will take place, including the use of tow trucks where necessary.
Can the police evict travellers?
Trespass is a civil offence, not a criminal one. This means that the police will not generally get involved in removing trespassers from private land. It is the responsibility of the landowner to evict the encampment.
They will visit sites that have been reported to them and investigate any breaches of the peace. If the group has taken part in criminal activity, then the police have the power to move them on.
Do I need to go to court to evict travellers from my land?
There is no requirement to gain a possession order through the court to evict the travellers from your land. The matter can be dealt with under common law, which is much quicker and cheaper. Our bailiffs are very experienced in dealing with these situations and the gypsies understand when they need to leave the land.
All our enforcement agents are suitably dressed, wearing appropriate PPE and body armour. They will also use a Body Worn Video, which can be monitored after the event. This ensures that any threats or intimidation will be recorded if required as evidence later.
Once on-site to serve the eviction notice, the agent will conduct a risk assessment which is sent directly to the office. This will provide details on the number of caravans, other vehicles, individuals and animals on the site, as well as any further risks that are present. The bailiff in charge of the operation will then use this to assess the number of enforcement agents required to carry out the eviction and any further assistance that might be required.
